I work for Employer A (who holds my H1) and I have an approved I-140 from Employer B, I-485 pending. Am due for H1B renewal this Dec, can I use my I-140 Approval (done from Employer B) to get 3 year extension when Employer A applies ?
Any Legal opinions will be appreciated.

Hi All,
My employer is going put one newspapaer ad for two employee's. He is doing this to save moeny. Is this ok to put one ad for two employee's? Will there be any probelm in PERM.

I received a status update email from USCIS yesterday on my wife's pending I-485 application. The status says "On November 5, 2007, the post office returned the notice we last sent you on this case I485 as undeliverable�.
The status used to say "application is pending" as recently as a week ago. If some notice had indeed been returned to them, wouldn't the status have changed around Nov 5, 2007? Could this be an erroneous online status change? We completed our FP back in Oct 2007. we have received EAD, AP, etc. on our address properly, and haven't moved.

My daughter (5 yrs) is an US citizen and having passport valid until end of Sep 2009 and having POI card for 15 years from Indian consulate.
Now I am planning to take her to India for 3 weeks from Aug 1st week. The travel agents says her passport should have at least 6 months valid from the date of date of the return (Aug 4th week). Is that true/correct? Can she enter here in USA after her India visit with 20 days left in the passport validity?
I will be using my AP though I maintain H1B status (I-797) and work for the same employer.

No, you cannot draw anything in Swift3D besides the simple polygons such as spheres, cones, etc. What you can do is create complex 3D shapes and import it into Swift 3D. Swif3D is used primarily for 3D Animation instead of 3D creation.

I have filed an appeal for a rejected I 140, which is I 290B.
I also filed a new I 140 using the same labor (EB3, august 2003)
Now I am seeing constant changes to LUDs to both status online, but the text doesnt change.
I 290B had LUD change for 3 days, and I 140 had LUD change for 3 days too.
I am confused now... does this mean they are working on the case?
constant changes like these furstrate me when there is no message or text change in status.
Can the gurus here predict according to similar trends? what can I expect?

Today I rceived someone else's EAD. We received three EADs, one each for me and my wife and another adressed to me with EAD inside being some one else's.
Weired ways of USCIS!!!!

I have an approved I140 and eligible to apply for I485. My wife is in the same situation.
Should we file separate? Or should I file only one application heither through my employer or hers?

Hello Members,
I noticed that the dates on my i-765, i-131 and i-485 changed to 9/1/2008 today. This has not changed since I got my EAD. None of my wife's dates have changed. Does this mean anything? The things I have done lately that might (or might not) have caused this:
- Called CSR to check on status. She asked me to call back as my processing dates are not current yet.
- my lawyer sent G-28 so they could check on any information for me.
Here is some info:
i-140: 9/26/2005
i-485: 7/23/2007
EB-2
Any ideas?

A consultant in my project recently got his visa stamped in India. He didn't faced any issues. They didn't even ask for client letter. I guess he is just lucky :).
I am going to India next month and need to get my visa stamped. I work for a TARP employer ... Lets see how it goes.

I have an issue with my recent H1B approval on Feb'2010. I am seeking your advice in this regard.
I have been in H1B since 11/01/2005 , entered US on 04/20/2006 and my PERM has been already approved with a PD of 03/15/2009. My current I 94 is expiring on 4/13/2010. Recently I got an H1B extension approval of just 1 year (4/13/2010 to 4/13/2011) , which is less than actual 6 years with approved PERM.
Do you think that any appeal or ammendent can be done to extend the approval period? With my H1B petition I had to enclose a client engagement letter which confirmed my engagement but didn�t have any engagement end date there.
