Form W-11, Hiring Incentives to Restore Employment (HIRE) Act.

What is this form? Are there any issues involved (in prospect of getting GC) in filling this to the employer??

I have an H1B approval from USCIS, and I am trying to go to Canada for the initial visa stamping. But then i have a problem. I initially entered the country as a visitor, and married a citizen, but only after my I-94 had expired for about a week. (My petition is still pending. The company I am working for could not wait for my greencard, since its already been years since I started that process, so they went ahead and applied for the H1B visa for me). I heard that it is a problem to do the visa stamping in Canada if you have been out of status before. Is it advisable to go to Canada for the visa stamping?

EB3 is not moving because there are way too many people in it. Spillover or no spillover there will still be 140K visas per year and with 7% country limit, Indians can forget our greencard. Country limits is a very bad thing for us.

Who created country limits and why?

I plan to tweet during my 3 days at DC during Advocacy Days, so I figured it will be easy if we have a hashtag for twitter.

    I was thinking #IV11

Anyone else planning to tweet during the event (between meetings)?

I have my H1B visa with NIIT. My petition and visa for the first 3 yr period expire in October 2008. I am returning to India in April '08 to do my MBA, and will resign from NIIT, and therefore will not be able to renew my visa.

If I want to work in the US after I graduate, say in August '09, can an employer file a transfer petition based on this visa? Or Will they have to file for a new one under the quota? And if so, is there a way that I can hang on to my H1 status?

    Thanks!

I am on H1B and my wife is in H4 here. She is a nurse and can apply for the AOS before Aug 17 .But she does not have all certificate that makes her AOS approved at this time. We hope that we can obtain the certificate (Visa Screen certificate) by the time the RFE comes. But it is a 50-50 chance only. So what could be the best option for us and consequences of each.
    My case (h1B)
    1. I also apply for AOS with her so that I can get aGC along with her but do not use the EAD .
    2. I apply for the AOS later but before her AOS approved.
    My wife case (h4)
    1. Apply for the AOS but do not use EAD
    2. Apply AOS and use EAD.
Also do you know around when the USCIS issues RFE once the application is recieved?
I really appreciate your advice in this.
    Shaji.

The 14th Amendment to the U.S. Constitution mandates an inclusive mathematical formula for apportioning "Representatives . . . among the Several states". It requires a decennial census count of "the whole number of persons in each State" excluding untaxed Native Americans. As the New York Times reports, a push is on, using Christmas-themed posters in Spanish, to urge Hispanics (citizens, legal residents and the undocumented, especially Evangelical Christians) to cooperate with census-takers and be counted when the tally begins in March, 2010. The effort is targeted beyond the Hispanic community, with posters offered in English ("This is How Jesus Was...

I do not see a problem in filing 2 Green Card applications. The one that comes first gives you a green card which most probably will be employment based. But you may consult an attorney as I am not one.
I am on H1 visa and I have a sister with citizenship.
I am wondering if I can file i-130 (family based immigration) now and file Employment based immigration later?
Is it OK to file 2 green cards applications? which one will take place then?

    Interesting

In FY 2007 there were 18 States with over 1,000 certifi
ed PERM positions, and in FY 2008 there were only
    12. Following this trend, there were only eight States
in FY 2009 with over 1,000 certifi ed PERM positions,
and in FY 2009 the number of positions approved in
each of these eight States declined signifi cantly. The
most signifi cant decreases occurred in California, Texas,
and Illinois, where the number of positions approved
declined over 45 percent from FY 2008. The most
demanded occupational positions in FY 2009 were
found in the Information Technology industry, with the
Advanced Manufacturing and Finance industries also
drawing a large number of position requests.

    Hi,

I know that this is not a "Green card related" question but an important question that I hope someone will answer. I am planning to use EAD after my I140 approval and jump to consulting business. I have thought about Self-employment but it sounds like it is risky. Are there any good consulting companies which charge very less percentage for having me as an employee on EAD. I hope that company can send AC21 and continue my GC processing.

    Thanks,
