The Senator Chuck Schumer (D-NY), the Immigration Subcommittee Chairman, told the AP yesterday that he plans on introducing a comprehensive immigration reform bill before Labor Day and then hopes to have a debate on the bill in the fall. Schumer hinted that advocates for highly skilled immigrants are likely to be happier with the bill than those pushing for guest worker reforms for lesser skilled workers and that business and the unions have yet to reach a compromise. You have to return both I-94's while ticketing ie before exiting and while entering at POE IO will give you new I-94 based on AP as Paroled AOS pending..
Ofcourse keep your copy of I-94 from your H1 Extension I-797 approval notice.

1500 H-1Bs were claimed in the last week and just over 20,000 remain for the fiscal year. Based on a four week rolling average (1175), I am projecting the target will be exhausted in 17 weeks which will be February 23, 2011. Previously, I had been projecting March, but the overall usage of H-1Bs has been somewhat busier in the last month than in previous months. The masters cap usage this past week was 500 and the monthly average is 450. There are 3,800 H-1Bs left of 20,000 and I am projecting that cap will be exhausted in late December,...

Hello,
Our H1B/H4 status has been approved with 3 yr extension. We have an approved AP also. As of today, I am on H1 (don't want to use it) and my spouse is working using EAD (got the EAD as a resultant of my 485 dependent).
Now, I have two Q's?
1. Since she is working using EAD and now that her H4 extension is approved, will this approval invalidate her EAD ?
2. If we go for stamping (and that our H1/H4 will be stamped), will that stamping also invalidate my spouse's EAD ? We can very well come back using Advance Parole, but to be on safe side we want to get the stamping done (as others suggest). Don't know what would be the correct and best way. Appreciate your response and advice.

I have a 4 year Indian Bachelor degree and 5 years of IT experience.
Of my 5 year experience
4 years is for My Company (India) Ltd
1 year is for My Company (US) Ltd.
Will my total experience be treated as progressive and can I process in EB2 category?
Kindly answer my query? Thanks in advance.
BTW Current Employment will not be counted.

For an individual, let’s say an I-485 was pending since July 2007 (I-140 approved) with current employer A and she moves to an employer B on a similar job on a H1-B transfer invoking the AC21 portability.
1) After the move, if the I-485 gets denied, can the person still retain the priority date of the underlying approved I-140 in any new application if she files with the same or a new employer.
2) After the move, if the I-485 gets denied and the person loses her job with the employer B, can she take a job with employer C by transferring the remaining time on her H1-B visa.

For the marriage, do you have any evidence of the marriage happening (like you can get something from the priest). You then go to the local registrar of marriage and show him the evidence. He will register the marriage and give you an official certificate. Your relatives in your home country should help you with this procedure.
For the DOB, look for FAQ on affidavits. Every immigration website has info on this.

You need to get a copy of 140, so you may have to tell your employer about your AC21 (actually no need if you have a copy of approved 140). Nothing to get scared of. But its good to leave in good terms.
Once you start using EAD your H1 will get cancelled anyway. So it wont make any difference if your old employer cancels it.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

Hi Guys,
I used to work for company �a� which was a part of the bigger company �A�. There was another company �b� which was a part of the bigger company �B�.
Now both companies A and B made a joint venture (JV) and made company �c� joining company �a� and �b�.
Company A has 25% stake and company B has 75% stake in JV(Company "c"). The new formed company "c" has �new name�, all employees filed �new employment applications� and have �offered a new employment� with the new company �c�
Now my question is as this company �c� is totally �new�, can I convert my EB3 case to EB2 and use company �a� experience and file for EB2 with company �c�

ur wife's parents can write an affidavit stating the petname alias realname.For instance if her petname is "rani" and true name "swathi".They can write an affidavit mentioning that" rani alias swathi "is my daughter in the affidavit and get it notarised from any lawyer in india.The sample format can be obtained from ur attorney.

My uncle just received his L1 extension receipt. Lawyer was late in filing the L1 extension, but supposedly got everything ready and mailed it 2 days before the L1 expiration date.
However, my uncle received recepit for L1 extension, and received date is 2 weeks after the expiration of original L1. Please note I am talking about RECEIVED DATE (not Notice date or receipt date).
Does this mean extension will automatically get rejected based on late filing? Is there any recourse to this?
More importantly, Is my uncle Out of Status now? (He doesn't have anything else going besides L1)
Please let me know as soon as possible.
