I am an analyst under H1B and I am involved in a sales process by developing a prototype for a client. My company wants me to give a percentage of total deal as commission. It will show in the pay stub as commission. Is it legal to get commission under H1B (please remember I am a programmer analyst) ?
As long as the payment comes from/through the company that is sponsoring your H1B, you're fine.

Has anyone contacted senators in NJ and got any response? I contacted them through regular mail filling out the forms from their website and enquiring on my pending 485 but haven't recived any response from either of them yet. I sent my papers on Sep 2nd and haven't heard anything back.

I see thread for all other years (2003, 2004, 2005, 2006 and 2007). So its my turn to open thread for my year.
Mine is EB2, Feb 2002. Still waiting. I was told that my NC is cleared.
3 SR, 2 letters to Ombudsman, letters to 3 senators, letters to 2 representatives, 2 fax to NSC, 2 letters to NSC Director, 1 infopass, numerous calls to NSC
Recently sent a letter to first lady. Looks like all of them are working together. Nobody wanted to respond.
Please feel free to write your experience if you are 2002 filer.

The New York Times today reports on a surgery that is heroic in scope. Japanese-born Tomoaki Kato, a surgeon at New York Presbyterian Hospital/Columbia led a 43-hour operation to remove a massive tumor(the size of a football) that had engulfed the liver and other vital organs of a 59 year old man who had been told the tumor was inoperable. Hello All,
My checks got deposited on Friday and when I checked my wife's I 485 status with the LIN # on the back of the check, it said that the finger printing fee was rejected and that the case is now in suspense.
It said that I have to submit a new fee and that the case will be resumed again.
Do you know why this happened. My bank statement says that the finger printing check for her got deposited.
So if there is a mistake in the check, would they still deposit it ? And would her EAD application get processed even if the finger printing fee is wrong ?
Did this happen for anyone ?

Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). I have a difficult situation , i have a H1B expiring in 5 Days and also ending the 6 yr period. My company is filing a H1B to L1A conversion application from US in premium processing
1. Is it legal to stay until L1A is approved? for duration of 2 weeks until L1 Premium processing is done
2. In L1A is rejected, would it be legal to travel citing the rejection of L1 petition
Please help me with any insight you may have

I have a similar question. My EB-3 PD is August 2005 (I-140 was approved but I never filed the I-485 because of retrogression). Few months back I found out that the employer had withdrawn/revoked the I-140. Now my employer is getting ready to file my EB-2 I-140 and my question is: Can we retain/interfile the priority date from 2005? I know the answer is yes but I am looking for examples where any fellow member was able to successfully do so. Thanks!

Hello Folks,
My H1b is 2 and half years old. I transferred it once, i.e in 2007
My brother has got GC a year ago and started his own company. I am planning to transfer it to him.
I have these following questions.
1. What is the risk on transferring my H1 to a new/small company in this recession period, and the employee strength is just one (my brother).
2. Is it ok to transfer more than one time in short period(i.e in 2 years span)?
3. Also, is it acceptable to stay outside US for couple of months on H1 status with out payroll? Will that be a problem at POE when i return to US?
4) Right now i am out of the project (on bench), so will that be any risk of my H1 transfer getting denied ?

I was H1B, but used AP return to the U.S. the same company, but when I filed the new I-9 form after return, the company lawyer asked me to write EAD and EAD expiration date, so I guess I am AOS now? or not? I am not sure. My company will resume my H1B this month, but don't know when it will be completed.
Now I am going to e-file EAD renew.There are some questions in the form I-765 that I am not sure how to answer (The lawyer has completed his 140 and 485 document, so he doesn't want to answer now.):
1, Manner of Last Entry into the U.S.: Should I choose PAR (PAROLEE) or H1B (SPECIALITY OCCUPATION)?
2, Status: Should I choose PAR (PAROLEE) or H1B(SPECIALITY OCCUPATION)?
3, Please select your eligibility status : Should I choose (a) (4) PAROLEE or (c) (9) FILED I-485?
