Hello,
I'd like to know can a dependent (not the prime applicant) on a pending 485 status, avail unemployment insurance, especially the extended benefits which are being given by Federal govt. to the states.
This is the latest from USCIS :

it says, that unemployment compensation is not public charge.
Does it even apply to both standard unemployment insurance and the extended benefits.

Hi All,
I have a simple question.
I have my I-140 approved with some kind of receipt number.
My lawyer filed my I-485 and it reached NSC on Aug 9, 2007.
I have not recd. any I-485 receipt notice or number yet.
Can i still track my I-485 progress using my I-140 receipt number on
the USCIS website somehow ?

We can see more of these GC approvals and visa number allocation in September because USCIS and DOS have to use up all available visa numbers.

I am on H1B visa and married to a mexican citizen for past 2 years. we both have been living in mexico for past 2 years ( i am working as an Expat). 4 years ago my wife was in US on a Tourist visa and attended community school to learn English. she left the country in 6 months but while re-entering she mentioned her going to school to the agent upon which they processed a expedited removal and put a 5 year ban. She will complete her 5 years in Feb 2012. We are going to have a baby soon and would like to move to US next year after her 5 years are complete. i want to apply for a H4 visa for my wife and my baby. Will her expedited removal cause a problem with H4 application? thanks in advance.

Hi,
My visa expires in May 2009. I applied for OPT and starting date will be from June 1st 2009. I want to go to India in the last quarter of 2009. How do I get a valid visa. Should I get a new F1 Visa? Please help me..
OPT is a part of F1, it is not a new status. Technically you can get a VISA stamp for your F1 during OPT, and many do get, but you need to prove "no intent to immigrate" during your VISA interview and that's harder to do when you are on OPT and working for some company.

Dear all,
Myself and my husband both have approved I-797 for H1B from different US companies.
I went for my stamping to US embassy and they asked for more evidence regarding the US company and my case is currently pending with them with all my documents ( passport, I797, marriage certificate, etc).
Now my US company is not able to get a job letter for me.
Meanwhile my husband is planning to go for his stamping. He has good evidence to support his case.
My questions are -
1.) How can I retrieve all my documents from US embassy without affecting my passport and my H1 case?
2.) If I am able to retrieve all the documents safely, can I apply for H4 with my husband`s H1 stamping?
3.) Will they create problem for issuing H4 to me because of my pending H1b case?
4.) With H4 visa and I-797 approval notice, can I start working in US ?
5.) What will be the best way out of this situation without affecting our working visas ?
Please reply if you know anything.

I am currently working for company A under H1B visa. Company B recently bought all of Company A�s Assets. I am still working for Company A (doing clean-up work) but will be laid off shortly (within a month). Company B offered me a similar position.
I read that since Company B bought all the assets and runs a similar business they would be considered as "successor of interest�, therefore, we would not need to file a transfer with USCIS and a simple letter would be sufficient.
How does that work exactly? Can I travel with my old visa and the letter? What happens if later on Company A is dissolved? Cancel the visa?
I think that Company B is ready to sponsor me for the Green Card. I�m not sure that they would be ready to pay for the fees for the transfer AND the green card now. I would really like to start the Green card process as soon as possible since it takes so long. I understand that it might be better to file a transfer to be on the safe side but if I can save some of the fees it would be great.

Hi,
I was working for a telecom company. I passed 6 years and then was on 1 year extension. Meanwhile my I140 was approved. Lately i was given pink slip and then transfer my H1 to another company. i couldn't join the company since i was waiting for approval notice for my H1 Transfer. Today i received the denial notice for my H1 transfer and extension. I called to the lawyer and they told me to file for B2 as they haven't received the notice as of yet. So the reason of denial is still unknown. I was wondering what are my current options? Should i wait and file a motion for the H1 transfer denial or should i go ahead with B2? Please advise.

They can incorporate a company but they cannot do any work for it( not even write a check) or take any salary from it. But if the person has an EAD, there are very few restrictions.

If you new H1 is approved with new employer (for 1 year or 3 years) and if the 140 is revoked AFTER your new H1 is approved, then it wont affect your H1 and it will be valid thru its term.
But if your old 140 is revoked, you will have to get new labor and new 140 going on before your new H1 expires.

With my HTC Mozart, I can download app called 'Stocks' which basically look after stocks (nasdaq etc...).
The charts/graph looks very nice and I wonder how they do that ?

I wonder if there are free/open ressource which can help to start to draw so nice graph. Any blog or hyperlink are welcome :ch:

I am a doctoral student in clinical psychology, graduating next year in May or October. I am currently on an F-1 student visa and have heard ominous things about getting an H1-b and GC in my field.
I know I have time and things can change, but it seems like they are becoming more difficult. Hence if there are people out there who have ideas, experiences and information to share about what the process is like for potential psychologists to get sponsored, I would greatly appreciate your reply.
