    Is it okay with AOS application to take contract Job after six month of AOS filling.

    I am getting a long term contract with better opportunities. How is the contract job interpreted with continuing AOS application

    Dear Experts,

    My wife's H1 is pending from H4. Its got selected in lottery and waiting for approval. But in the mean time we have to go to Canada and come back within 3 days. I would like to know if this impacts the COS. If it so, what are the options, means again can we apply for COS once we get the H1 approval without COS? Please let me know the options.

    My wife was on same boat as many students. Her H-1B petition had an rfe. RFE was later denied and we still have MTR. This year she got her H-1B approved without RFE. We did specify in application about previous year rejection.

    Bottom line is there are no easy trends to observe. Luck seems to play a big role than anything else. Obviously, all the documents must be in good shape.

    My current AP expires on July 30, 2008. I am planning to apply for renewal in Jan or Feb 2008, which is 6 months prior to expiration. I understand that nowadays it takes more than 3 months for approval.

    In case of emergency, Can I travel to India with my current AP while AP renewal petition is pending?.

    I was on H1 visa and laid off from job on 10/30/09. I got severance pay for Nov. and have the pay stubs. I applied for COS from H4 to F1 for my spouse (already in collage) and H1 to F2 for me on 12/9/09. Meanwhile immigration performed spot check at my ex-employers on 12/3/09, so they came to know that i was not working. My employer had not revoked H1 by then. Our COS application was received by USCIS on 12/14/2009, case is currently under Initial Review.
    - Will the immigration officers who did spot check inform USCIS that i was out of status?
    - Will case get rejected due to delay in applying for COS?
    - Will there be any complications in transferring my H1 to new employer as i was out of status for about a month before i applied for COS?
    - How to stop F2 COS if i get H1 transfer approved first?

    Given the uncertainity of getting green cards and the possibility of having to move back to India with your US born kids I would like to seek opinions on what IV members think is a relistic timeframe for kids born and raise in US to be able to tranfer to schools in India and still able to adjust/cope.
    I am refering to regular SSC/ICSE/CBSE school in India (not IB or International schools). I am sure that the workload and requirements of the Indian schools is much rigorous then public school in US.

    I have seen references that if there are different I-140 apps approved per family, there is a possibility of going for the 485 stage separately. Also I have seen posts stating that one can go for AOS and the other for CP.

    How do you communicate to USCIS that for one you are doing AOS and the other you are doing CP, with reference to the 485 stage? When does this really happen?

    The answer is that you chose AOS/CP at the time of 140 filing.

    It has more harm than good. H1B fees increased too much. I hope they will remove this H1B part from the final bill. Anyway Bush is ready to veto this bill for sure.

    Hi all,

    My ETA case in online status shows "DATA REVIEW" for the past 5 months, my PD Aug 04/RIR/EB2 is with Dallas BPEC.Initially the status was closed, and then opened. After 5 months of reopening it still says 'Data review' .Is there some thing wrong or should I talk to my lawyer.

    Some of my friends who applied that time have their status 'in process' or even 'certified' .Any experience like this or will that go to certified from here directly or to "in process" first. How long it can be in each of these statuses.

    Any ideas appreciated please!

    For how many years does the employer have to guarantee that it has funding to pay my salary? Or how does this thing work out. My employer has 300+ employees.
    Any other requirements from the employer?

    The employer has to be big enough (300+ is a big company) or if small (such as less than 15), it has to show company's return and sometimes business in hand.

    ICE has announced sentencing in two cases related to visa fraud. Houston immigration lawyer Kenneth Rothey has been sentenced to fourteen months in prison for money laundering and visa fraud. Rothey was convicted for his role in securing L-1 visas based on manufactured corporate relationships.
