Have another PERM labor approved but am hoping this one gets approved so I can get the earlie PD.
Going by the recent trend (per spreadsheets generated by someone at immigrationportal) I am actually thinking there might be a chance all the BEC backlogs get cleared by December, if not by the stated goal of September.

I never give any red or green dot to anybody nor do I care what I have. As, you said what you felt was right, other users did the same to you...
I got red dots, just because I raised my concerns against factual errors in the letter. I have never mentioned that I am against sending letters. Just that emotional outburst is not going to help EB-3 India applicants.

I agree with your points. Just adding few comments.
Huge debt for everyone? This is going to be the biggest problem because in US, we have a foundation for debt based economy (SSN, credit history, Credit score, credit ratings etc.) If you default the payment, you will have an effect and there will be an impact on future credit applications. There is nothing of this sort in India and the politicians will not allow such things to be setup as well. So essentially back to my point. Banks who lend money are at bigger risk of loosing it. There is nothing that they can do to report on consumer's default or fraud for that matter.
Now per say consumer dump the property or bank attaches it for non payment of loan amount, Bank will be stuck with properties worth 1/4th for those crores that they loaned to people, maintenance will cost them more to prepare it for sale.
In any account, there is a big problem ahead there.

Its shocking!!! They've foolishly approved many 2006 cases and dont tell me it was unpredictable and now ppl with 2003 r still waiting....how logical is this? A bunch of A** H**** working there or what?
I know, this is very illogical. And very upsetting for the people who are waiting for a long long time. Hopefully, we'll see a shine in the clouds this year. A lot of people are aware now and have stood up against the "injustice" since last year, mainly through the efforts of IV.
And I strongly believe that higher is the volume of the prayers, sooner they get answered.

I was kind of oblivious and busy in my work since I applied labor �and was thinking everything will fall in place gradually..

My attorney applied my Labor in Nov 2006 (according to him) in Atlanta and I still don�t have any response �no audit �.nothing �.it is just in process�can u believe it?

I hope 140 and 485 is still not in retrogression state �. Do u guys know how long it will continue to be in this state�
You can ask your lawyer to send an email. I have read some cases in IV where after 90 days if the lawyer/employer sends ane email they respond with the status . why dont you try that?

Here is the scoop.
from US Congresswoman's office, an immigration specialist spoke to their liaison at the Nebraska Service Center.
Liaison confirmed the following:
1. I-140 approval in September, 2007 (actually 09/04/2007 as I have the hard copy)
2. I-140 revocation in Feb, 2009 ( he has not provided the day of the month, but from LUD I have it strongly pointing to 02/03/2009)
I have not told the Congresswoman's office about the I-140 revocation. Just mentioned that it might have happened as I have left the company.
3. Liaison did confirm that even after the I-140 being withdrawn I am eligible for adjustment thru AC21.
4. Liaison did agree that if the I-140 was revoked within the stipulated time given in AC21, Nebraska’s decision to deny the I-485 may have been in error. (which in my case is true)

Unanswered questions:

I am in a bind now, appreciate any advice,
I am planning on using my EAD to switch to another job in a couple of months. Meanwhile I have booked tickets for May 26th to send my son to India for the summer. He has H4 stamped in his passport valid till 2010.
My question is
**Can my son come back on H4 even though I use my EAD to change jobs ?
**Does he need to have advance parole ? Even if I apply for AP tomorrow, chances are very slim that he will get it before he leaves on May 26th.

If you switch Jobs, and you don't have your H1B transfered to the new employer this means your H1B is not valid. No your son can not entry the country on H4 he must use AP. But if you continue to work full time on H1B and work part time on EAD with another employer then he can come on H4.

The bill being discussed in the senate if passed is going to be very detrimental to people that are stuck in the labor backlog centers. They wil be forced to redo their labor with the new point based system. That is not fair at all.

I have talked to a representative and he very patiently explained me about the mess.
He clearly and very clearly told me that they have a deadline to send all receipts for June end and July 2nd filers by friday (tomorrow) or worst case monday.
He mentioned that they are working hard to meet this deadline.
Hope this clears the anxiety.

I dont see anything about the law suit on OH site.
Can someone explain what "Temporary Restrain Order" would do if it were successful. It sounds to me that the lawsuit is asking the court to temporarily invalidate the July visa bulletin so that USCIS will be forced to accept the applications. Is this a reasonable understanding? Any lawyers here?

can we put up forum threads here for state chapters or some kind of direct link or page for each individual state chapter
Doing state chapters through list servs is just not working out.
Most people here just want to discuss but when it comes to action - you will notice that they would not even give out their proper name to IV while registering - so mobilizing is not as easy as discussing it here.
Discussion forums are good because ideas emerge here - ideas are needed for execution and discussing pressing issues must lead us towards a path to execution.
The question is - can all those who do that talk actually walk the talk?
